Welcome to MAVRIQ AI. These Terms and Conditions ("Terms") govern your access to and use of the website located at mavriq.co.in, as well as the AI Calling Agent, Voice Bot Automation, and related services provided by MAVRIQ WEBTECH INC ("Company", "we", "us", or "our").

By registering an account, integrating our APIs, or utilizing our conversational AI platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Description of Services

MAVRIQ AI provides an AI workforce platform that enables businesses to build, test, deploy, and monitor customized AI conversational agents. Our services include, but are not limited to, voice synthesis, automated inbound and outbound calling, API telephony trunking, bulk calling capabilities, auto-syncing knowledge bases, warm call transfers, and automated appointment scheduling (collectively, the "Services").

2. Account Registration and Security

To access the Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and any API keys generated through our platform. You are strictly liable for all activities that occur under your account, including any workflows or automated scenarios executed through third-party integrations connected to your MAVRIQ AI environment.

3. User Obligations and Telephony Compliance

Given the nature of AI voice bots and bulk calling features, your use of the Services must strictly adhere to all applicable local, national, and international laws, including but not limited to:

  • Telecommunications Laws: Compliance with regulations governing automated dialing, bulk calling, and unsolicited communications (e.g., TCPA in the United States, TRAI guidelines in India, or equivalent regional laws).
  • Call Recording and Consent: You are solely responsible for obtaining necessary multi-party consents before utilizing our AI agents to record, transcribe, or analyze phone conversations.
  • Prohibited Content: You may not use the Services to generate, broadcast, or synthesize audio that is fraudulent, defamatory, impersonates another individual without consent, or facilitates illegal activities.

4. Third-Party Integrations and Providers

Our platform allows for seamless integration with external applications, including third-party Voice synthesis providers, Large Language Models (LLMs), and workflow automation platforms.

  • Service Availability: We do not guarantee the continuous availability of third-party APIs. Any latency, downtime, or policy changes from our integrated partners are outside our control.
  • Third-Party Terms: By connecting these external services to your MAVRIQ AI agent, you agree to abide by the respective terms of service and acceptable use policies of those third-party providers.

5. Intellectual Property

  • Our Rights: MAVRIQ AI retains all right, title, and interest in and to the platform, including the intuitive agent builder, underlying code, proprietary algorithms, and dashboard interfaces.
  • Your Data: You retain all ownership rights to the specific knowledge base documents, scripts, and customer data you upload to the platform for the purpose of training or syncing your AI agents. You grant us a limited, secure license to process this data solely to provide the Services to you.

6. Payment and Subscription

Access to certain premium features (such as custom AI voices, extensive API trunking, and high-volume calling) requires a paid subscription. All fees are non-refundable unless otherwise required by law. We reserve the right to suspend or terminate services for accounts with overdue payments.

7. Limitation of Liability

To the maximum extent permitted by applicable law, MAVRIQ AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Due to the probabilistic nature of Artificial Intelligence and real-time network conditions, we do not warrant that the AI agent's responses will always be 100% accurate, or that voice transmission will be entirely free of latency or dropped connections. Users are advised to utilize the built-in testing environments before deploying agents to live customer calls.

8. Indemnification

You agree to indemnify, defend, and hold harmless MAVRIQ AI, its directors, employees, and agents from any claims, damages, liabilities, or expenses (including legal fees) arising out of your use of the Services, your violation of these Terms, or your infringement of any third-party rights, particularly regarding telephony compliance and data privacy.

9. Modifications to the Terms

We reserve the right to modify or update these Terms at any time to reflect changes in our Services or legal requirements. Continued use of the platform after any such changes constitutes your acceptance of the new Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Chandigarh, India.
